This is a concession by the U.S. government that its “arrangement” with El Salvador is irrevocable. To me this has to be grounds to argue that the arrangement itself is unconstitutional under the Fifth and Eighth Amendments

It's horrible whatever you call it, but forcibly sending citizens out of the country is more like exile than deportation. They are working on sending citizens into exile, which at a minimum is cruel and unusual punishment for any crime, and therefore highly unconstitutional.
