BTW, this is what @anthonymkreis.bsky.social and I keep referring to as the Dunning School of Con Law b/c we have willfully failed to understand the constitutional implications of the Civil War. I wonder how many Con Law and Admin Law scholars have actually read the Confederate Constitution?

I am not confident that the Administration is adhering to the law as tightly as it can and should. And further, without invoking the Insurrection Act, I think it is plainly absurd to deploy active duty Marines to control a civilian protest.

Question 3: Can the Marines detain people? Is it really a detention? If they're out on the streets doing ordinary civilian policing beyond very closely guarding federal persons and property, and they're detaining (but in reality de facto arresting) civilians, we have a Posse Comitatus problem.
