You know when it's @elienyc.bsky.social it's going to be an extra-spicy interview! Elie minces no words when he says that SCOTUS' anti-trans decision will "live in infamy." Get his take on that case, as well as some other SCOTUS decisions that remain pending: youtu.be/Kg_szbiSGbE?...

Four months later and we’re likely to see Congress do away with this. What world am I living in?

This is the most important thing I have written recently that you probably haven't read. www.democracydocket.com/opinion/the-...

I agree. So why won’t HRC change its corporate equality index to reflect political contributions which are easily trackable? Your two indexes are incompatible. On one side, HRC ranks politicians from 1-100, but then gives the companies who bankroll politicians who received “0” w/ perfect scores.

The Dept. of Justice has filed its first voter suppression lawsuit aimed at disenfranchising voters. This is a critical juncture for democracy. Paige and I discuss the implications and how it echoes claims made by failed state Supreme Court candidate Jefferson Griffin. youtu.be/8XEW-Ga428M

Wanna see something incredibly ... bad? Here's Alito quoting a source to suggest that you can't do habeas class actions: 1/

If you are watching DOJ target a Harvard researcher or Trump's political opponents and think its vindictive, politically motivated and improper, then you understand why courts must stop giving the Trump administration a "presumption of regularity." www.democracydocket.com/opinion/the-...

Crockett: I cannot wait until voters have an opportunity to say: You took food out of my mouth. You took a roof from over my head. You are responsible for making sure that I do not have health care. I'm going to make sure you don't have a job.

I'm trying to come up with a metaphor for how the Trump administration's gamesmanship (e.g., moving detainees around to try to defeat jurisdiction in specific districts) helps to drive home the dire consequences of a #SCOTUS ruling that would limit universal injunctions. "Cheating at Battleship"?

Trump's post is a federal crime. 26 USC § 7217.

In Minnesota, freedom is a birthright.

Given the literal definition of deportation is removing a foreigner or noncitizen from the country, we - journalists, media orgs - should probably all stop referring to the ‘deportation’ of a 2 year old US citizen. It’s NOT a deportation. I’m not sure what it is. A kidnapping?

There’s no Alien Enemies Act exception to the Fourth Amendment.

Today marked the 250th anniversary of Lexington and Concord and this is what the second-largest city in the United States is choosing to honor on its public sidewalk, over four years past 1/6/21, all because @cd13.lacity.gov won’t introduce the motion to remove it. Here are a few L.A. City…

I am old enough to remember when a movie character said "PAPERS PLEASE" it was a universally understood signifier of an evil regime

As a person who hails from the small New England town that hosts the rifle that allegedly fired the shot heard ‘round the world, this 250th anniversary of those events at Lexington and Concord I’m thinking about the preposterous notion that one man who openly defies the U.S. Constitution; an…

With these posts, they’ve made it essentially inarguable that they’re deliberately defying the Supreme Court.

Wonderful.

@jasmineforus.bsky.social please consider asking HRC why they continue to give perfect “Equality Index Scores” to corps. subsidizing the political campaigns of anti-lgbtq legislation & legislators. I’d love to speak to your office. @juddlegum broke the story years ago. Almost nothing has changed.

President Trump may soon try to invoke the “Insurrection Act” to trigger the ability to use the military for domestic law enforcement. Today’s “One First” offers an overview of the statute; how it’s been used; and what might happen if Trump tries to use it now: www.stevevladeck.com/p/142-five-q...

If the U.S. government is going to take the position that, once removed from the United States, folks can’t be brought back, then it sure seems to me that federal courts should be reflexively and categorically barring *all* removals until they’re 100 percent certain that the removals are lawful.

100%. It really is time to go there. Again.

So much for “facilitating”

#BREAKING: Supreme Court holds that Trump administration must attempt to “facilitate” the return of Wilmer Armando Abrego García from El Salvador, but remands to the district court to sort out exactly what the administration can and must do going forward: s3.documentcloud.org/documents/25...

Rule of Law is in the rearview mirror.

Jamie Raskin is one of the few true public servants out there.

This is a top news story. Where are all my constitutional crisis people?

In theory this nightmare could end today:

Sotomayor is right. According to this Supreme Court, the US can now kidnap, detain, and fly legal immigrants and citizens to a foreign country's prison, even if it's a whoopsie. America, people. Freedom and stuff.
