If the government were hurtling people into space without due process, people in danger of being so hurtled should be able to get an injunction saying the government can’t do that to people. The Administration’s position is that this is, in effect, what they are doing.

As I’ve said, yes, this was their aim all along. That’s why they didn’t just send these people to Gitmo. This is an attempt to find a step beyond Gitmo where the court says, “Well, our hands are tied.” It’s an awful, lawless gambit that must fail, but that is what they want it to be.

The principle at stake here is so fundamental it predates even Magna Carta in English law, and before that stretching all the way back to Rome, and has its similarly ancient equivalents in every legal system in the world, because it's the inherent bedrock foundation of what courts and laws are for.

Trump is also saying that the once the US has rounded up individuals, with minimal or zero due process, on whatever pretext they choose, they can send them out of the US to face torture, death, life imprisonment, slave labor or other fates that are unconstitutional or illegal in the US.

This would be so incredibly stupid and thus cannot be ruled out.

The administration is going to run into a legal bind. (1) As a baseline OUTER limit, the written agreement with El Salvador is limited to 1 year. (2) The text reads: "pending the United States’ decision on their long term disposition."

It is very good question and one I’ve been asking for months. If there is an international agreement with El Salvador for these renditions, the Trump administration is legally required under the Case-Zablocki Act to share it with Congress. To my knowledge, they have not done so.

the transfer to El Salvador of US deportees is, per Pres Bukele, a straight up contract that has “nothing to do w/foreign policy.” The fees we are paying makes their entire prison system “sustainable.” Don’t see how US can make argument that bringing A-G back is some sensitive foreign policy matter

I agree that this is the logical endpoint, but it is also likely its Kryptonite because then it makes our courts impotent. Courts don’t like giving up their power (see post 9/11). So the endgame, if the courts want to stay relevant, is to say the whole thing is unconstitutional from the jump

This is a concession by the U.S. government that its “arrangement” with El Salvador is irrevocable. To me this has to be grounds to argue that the arrangement itself is unconstitutional under the Fifth and Eighth Amendments
