To be clear, except in rare circumstances where an immigration case goes through two levels of appeals, the administration doesn’t have to “appear[] before a judge” to deport someone. They have to appear before one of their own employees who puts on a robe and pretends to be a judge.

More than anything, these features of the order remind me of a stay of execution. Which doesn’t say much about how this Court will ultimately go on the merits. But it does suggest, at least, that Abrego Garcia has showed them that the harm of inaction here is truly irreparable, like an execution.

I find myself getting sincerely emotional about this. That he’s, under the circumstances, okay. That his wife and kids know this after an agonizing month without him. That a Democratic politician cared enough to go and see him, even after getting told no at first. Trying matters. Fighting works.

It’s clear now, if it wasn’t before, that any lawyer with a semblance of ethics still employed by the federal government needs to be prepared to be fired any time. If you’re not prepared for that and you stay in the job, you’re setting yourself up to be pressured to act unethically or illegally.

painting with a broad brush, but people hire these big firms because they think they’re hiring the best fighters around, but this is what you really get. rich people who don’t know how to stand up for themselves, much less you. let them do M&A and IPOs or whatever. work that requires no principles.
