Some people will lose access to their doctors, their grocery benefits, housing support, or income right now if you all can't stop 47 from doing this.

Checking the state law, there are two criteria which might apply to upgrade this to 1st degree- either the defendant(s) tortured the victim, or the murder was committed while committed another serious specified crime.
It's also possible that this is an initial charge to keep them in jail for now.

I also visited, the thing that sticks with me is the window you see when going down the stairs. A list of all the towns that lost people due to the Holocaust. Names an inch high, single spaced across a ~10 foot window, four stories high.
That is what really made the scale of death hit home for me.

The thing is that if anyone in his situation (autistic or not) genuinely didn't mean it as a Nazi salute, they would have released a statement explicitly stating that it wasn't a Nazi salute and condemning fascism. Even without the social awareness, assistants would advise him on it so he'd know.
