No one actually believes in "do no evil (at all)", such a person would necessarily condemn all surgery, for example.

Not really. High IQ correlates with "functional empathy" rather than "empathic concern". Intelligent people are more likely to act kind if they have empathic concern for well being of others, but aren't more likely to have empathic concern.

"Least evil" would not be a fallacy, but "lesser of two evils" can suggest forcing a dichotomy and hiding other choices, which would involve fallacies. This is why it's often called a fallacy.
