It is urgent to realize that the case in front of Boasberg is a golden strategic opportunity. Legally, and I bet politically. Their legal position is terrible, the underlying facts look worse every day, and their attacks on the judge are batshit. Don't shrink from this fight, embrace it.

Unfortunately this isn’t just a Trump/ICE problem. This is 100% consistent with how cops tag people as gang members nationwide.

As I said the other day, what Judge Boasberg is doing here is building in insurance against appellate review. He wants plaintiffs to be able to tell the DC Circuit that the district judge gave DOJ every opportunity to comply with his orders. I know it's frustrating, but that's what is going on.

This is one problem for DOJ with acting the fool in front of Judge Boasberg - other judges will start concluding the Government cannot be trusted in litigation.

People need to be crystal clear about something: The requirement that the government ANSWER to a court on the legal basis for detaining someone is literally the core liberty right (habeas corpus). If the government says they don’t have to do that bc “national security,” YOU can be disappeared.

Some realpolitik: I would like Judge Boasberg to drop every possible hammer on DOJ. I just note for the record that the more aggressive he is, the more likely some kind of stay is from a higher court. It's a difficult to navigate balance.

If the gov't were on the right side of this, all of the guantanamo cases at SCOTUS would have gone differently 20 years ago, and they would have said "we have no jurisdiction at Guantanamo bay, the president can do whatever he likes there, constitution be damned."

And here we have the incoherent and ungrammatical appeal to "sensitive national security"

Look you can’t just go to a federal judge and say “I won’t tell you, and I won’t tell you why I won’t tell you.” There has to be some legal basis for the not-telling.

We didn’t violate the order because we say so and anyway you have no jurisdiction; we won’t answer any questions because national security so you can go ahead and cancel that hearing
