I never said he was wrong for restraining the guy. Just said that it could have been done without choking him the whole time.
In truth, this world needs to do better when it comes to mental illness. Unmedicated schizophrenic ppl should not be riding the subway. They should be getting medical help.

If he had a weapon, or even if he tried to attack someone, there would be no discussion. Justifiable homicide, no question.
But he had no weapon, attacked no one.
He was killed for yelling. No words, spoken by anyone, should be a death sentence.

And he could have easily protected those ppl WITHOUT killing him.
You get in a fight, other guy dies. You didn't intend to kill him, but you did. That's still a crime.

What Penny did would be the equivalent of police beating someone who is already handcuffed in the back of a police car.
After the first minute in that chokehold, Neely was no longer a threat. I'd be surprised if he was even conscious.

And he CHOSE to use lethal force anyway.

Bro. Penny had him restrained. All he had to do was NOT squeeze the neck. Cops would have come at the next stop. Neely would have been arrested. And no one dies.

He didnt just collapse and die. He died from being choked for 6 minutes.
Penny easily could have held him, without choking him, until police could arrest him.
First responders should be charged with negligence too.

Nelly (victim) was threatening to kill people on the train. Penny, put him in a rear naked chokehold, and held him in it for 6 minutes.
Anyone who knows anything about MMA, knows that this kind of chokehold will usually KO someone in less a minute. 6 minutes...you are trying to kill him.
