I agree with those caveats but don't think the habeas element justifies having 'mixed feelings' about this ruling. This ruling should be seen as horrifying. That it could have been even worse shouldn't change that. We must avoid contributing to dragging the legal overton window so far to the right.

The *smallest* of silver linings imaginable. Nearly all of these habeas hearings will be in Texas (and hence the 5th circuit) - the most radically conservative district in the whole of the US. And that's if they even happen at all, the victims will be the least likely to be able to secure counsel

Is it really a big deal? I'm not US-based, but doesn't reducing this to habeas mean cases can only be determined on a case-by-case basis (i.e. the policy itself can't be challenged) and will be determined in the district they are detained (hence incentivising detention in conservative districts)?

Yeah, it feels pertinent in the animal rights context too. The dream of a world that respects and protects the fundamental rights to all sentient beings seems ever more remote in the face of a regime that views basically all humans in solely instrumental terms, as things to use and dispose of.
