I didn’t have the Supreme Court destroying the authority of federal district courts on my bingo card. But in retrospect that’s perhaps where all this shadow docket decision-making was going all along. Really scary stuff.

Folks, this is why “it’s a distraction” takes are dumb. We make noise about everything that matters because (1) it matters, and (2) right now noise is all we’ve got, and noise isn’t nothing.

A part of me thinks it’s bc of the attention the Alien Enemies Act expulsions got. Extensive media reporting & public outrage over the admin’s lawless denials of due process. There hasn’t been the same kind of coverage or focus on 3rd country removals - even tho they’re no less appalling or lawless

Today’s unsigned, unexplained #SCOTUS ruling clearing the way for removals of migrants to third countries without any additional process is a disaster—not just on the merits, but because of the government misbehavior that it not only refuses to punish, but effectively rewards. Me, via “One First”:

The majority opinion is rubbish, but this separate writing is utterly divorced from reality. The ban at issue literally proves widespread operationalized animus.
