Before folks overreact to headlines about the judge’s ruling in the Khalil case, please note that (1) it was an immigration judge (IJ), not a federal district court; and (2) the IJ had no power to consider Khalil’s constitutional objections. This particular decision was a fait accompli.

While the SCOTUS decision stings for empathic and reasonable human beings re AEA and TDA deportations, it's important to note that anyone can bring a habeas petition to the court regarding removal of a suspected "alien", the more important case of the week should be later this week re Abrego Garcia.

Everyone's dander is (understandably) up. But it seems worth emphasizing that the federal courts, *including* the Supreme Court, are moving with remarkable speed to deal with the unprecedented flood and gravity of Trump cases. I get the demand for *faster,* but let's not lose sight of the baseline.

Acting by himself, Chief Justice Roberts has issued an "administrative" stay in Abrego Garcia, temporarily pausing Judge Xinis's order (which had required the U.S. to return Abrego Garcia by this evening). In a nutshell, it's a temporary pause to buy the full Court more time to rule on the dispute.

I think some in the Senate have convinced themselves that the backlash to folding will be limited to “the left” and therefore ignorable. Those people are deeply and profoundly misreading the moment and the stakes. Virtually every swing district House Dem walked the plank to vote NO for a reason.
