You can, but most of the time it'll fail. It only worked once when SCOTUS found that JGG v Trump was supposed to be habeas corpus, though they crippled the AEA.

Also I should mention that presidents (not just Trump) often appeal court rulings almost instantly most of the time, nothing new. Trump's been the most notable here though since he's deliberately breaking laws.

Yeah and there isn't really anything they can do there anyway constitutionally. Even if the insurrection act gets invoked, all they generally get is law enforcement duties, and those being detained have to be released after the act isn't invoked anymore. Trump is heading for a fall.
