Judge Breyer found that Trump had also violated the statutory directive that Guard federalization must be ordered "through the Governor." This too rendered his federalization a nullity (ultra vires) and without legal force.

Clearly the unpopularity of Democrats in Congress is due to their own base feeling these Democrats have not done enough to oppose Trump and Republicans. Those Democrats the most active in this regard enjoy high approval among Democratic voters.
