I've now had a chance to read Higgs. Underhill LJ had to work very hard to find a way to explain what's grown from a throwaway line in para 68 of Page (with an unrealised typo). It seems to me to be an issue begging for Supreme Court clarity, but I struggle to see how this appeal gets there...

Higgs v Farmor's School is out. A victory for the claimant. The CA judgment is mega-long for the CA (181 paras) but you can skip to para 175 for the "broad summary" if you wish (though Underhill LJ stresses it's no substitute for a careful read! www.judiciary.uk/wp-content/u...

Court of Appeal handing down judgment tomorrow morning in Higgs v Farmor's School. Will the Court take the opportunity to sort out all the confusion on philosophical belief discrimination, or will it be a bit of a damp squib due to the refusal to allow the school to cross-appeal the best points?
