Just before 1 a.m., #SCOTUS stepped back into the Alien Enemy Act litigation with a (remarkable) ruling that suggests, among other things, that a majority of the justices is tiring of the Trump administration’s Calvinball. For more, see the latest “One First”: www.stevevladeck.com/p/144-the-su...

If you're looking for an explainer on why due process matters to share with friends and family members who might ... need convincing, I've removed the (partial) paywall from my March 19 post for "One First" on the topic: www.stevevladeck.com/p/bonus-133-...

Nebraskans voted for Trump over Harris 59.32% to 38.86%. Here’s what that got them.

Talked with @andersoncooper360.bsky.social about what is, and what IS NOT, DEI. And what Trump & his confederates are trying to accomplish with erasing the accomplishments of non-white people, women and LGBTQ people.

Something we haven’t focused on enough is that the Trump administration isn’t just deporting people without process, it’s deporting them & incarcerating them in inhumane conditions in a third country. And we are paying for that cruel & unusual punishment that our government is imposing.

The Department of Justice was created in 1870 with an explicit mission to protect civil rights and enforce the 13th, 14th and 15th Amendments. The DOJ went after the Klan hard, securing thousands of indictments and 600+ convictions within the first year alone. How about restoring *that* focus?

A federal court’s jurisdiction does *not* stop at the water’s edge. The question is whether the *defendants* are subject to the court order, not *where* the conduct being challenged takes place. Were it otherwise, the government could act lawlessly overseas and courts would be powerless to stop it.

Update: Chief Judge James Boasberg rules for plaintiffs: "Given the exigent circumstances that [the court] has been made aware of this morning, it has determined that an immediate Order is warranted to maintain the status quo until a hearing can be set."

With his permission, I'm sharing Dean Treanor's response to Ed Martin's letter:

Tom Friedman: "This is a total perversion of U.S. foreign policy practiced by every president since World War I. My fellow Americans, we are in completely uncharted waters, led by a president, who — well, I cannot believe he is a Russian agent, but he sure plays one on TV."

👀 “I understand my duty as a prosecutor to mean enforcing the law impartially, and that includes prosecuting a validly returned indictment regardless whether its dismissal would be politically advantageous, to the defendant or to those who appointed me.” - Former Acting USA, SDNY Danielle Sassoon.

Trump’s effort to restrict birthright citizenship by executive order is (1) unlawful; (2) predicated on conflating two entirely distinct legal arguments; and (3) doomed to fail in (even these) courts. My “One First” explainer: www.stevevladeck.com/p/bonus-112-...
