Supreme Court grants cert in a Fourth Amendment case. The QP in Case v. Montana concerns the contours of the emergency-aid exception to the warrant requirement. This is the first cert grant in a non-1983 4A case since Lange v. California, 141 S. Ct. 2011 (2021).

This note from one of my 1L students means a lot to me. They’ve had such a tough year with the fires, mudslides, and long commutes caused by road closures.

I'm very sad to hear of Justice Souter's passing. He was a true common law judge who approached the job with great humility. Shortly after retiring from the Court, he delivered a graduation speech at Harvard on constitutional methodology. It's as timely now as it was then. Worth your time today.

When I was a student editor on the Virginia Law Review in 2014, we had a small event for our DC alums. After our EIC gave a short speech, I turned to my left and was shocked to see Ed Kneedler (a living legend by then). He introduced himself. I later learned that he often attends events like this.

It was a nice surprise and great honor to receive the Waves of Excellence faculty award for excellence in teaching. It’s an important reminder of what my mentor John Jeffries once said— that the first duty of a law professor is to teach.

An article never feels complete until I receive the hard copy. I had a great experience working with Notre Dame Law Review on this one.

We safely evacuated Malibu early yesterday and have been watching the devastation of the Palisades Fire from afar. Our home on @pepperdine.bsky.social's campus is not currently at risk; the burn scar from the December fire should serve as a buffer. Many of our friends are not so fortunate.

We are safe. Our family evacuated around 11:30. The flames came very close to our on-campus home. But it was not damaged. No structures damaged at Pepperdine at this point. But the fire is still raging elsewhere in Malibu. #FranklinFire

College football prediction: I think we’ll start to see NIL collectives offer large bonuses to star players who agree to play in bowl games (to counteract NFL-bound players’ rational decision not to play in them). Maybe this is already happening and I’m just not aware.
