The famous rallying cry was “no more Souters.” But I wonder whether, in this fractious time, we actually need more David Souters, rather than fewer. On this gray morning, the world certainly feels like a poorer place without David Souter in it. RIP.

Perhaps that simply reflects the relative scarcity of entry-level opportunity. IOW, if there are fewer spots the young, there may be more competition (and thus a de facto increase in writing expectations) for those spots.

Yes, it’s tough. I had two articles and was able to write them only because I was intentional about taking breaks to write between clerkships and other jobs. I realize not everyone will have those circumstances.

…and to those thinking that the top schools would never hire straight from practice, I’d point out that Yale’s entry-level hire last year came straight from practice.

It’s still possible to go straight from practice to TT. I did it a few years ago and have seen others do it in recent years as well. I wish more people would try; it would help push against the VAP-requirement assumption held by candidates and appointments committees alike.

Yeah, that might be true. But the bonuses could similarly apply to the CFP, to the extent players drop out of them like they do the bowl games.
