I've been watching this one since I saw the amicus brief of former legislators, some profs, and judges. I'm going to peruse the standing section closely. The statutory and broader "Congress holds the tariff powers" (my words) analysis seemed pretty clear to me.

Trump left West Point after his speech instead of staying to shake the hand of every graduating cadet, as is longstanding tradition. If Obama or Biden had done that, we would never the hear the end of it. But it's Trump, so reporters don't care.

This is all correct (and you should read it) but to be fair - the majority was just calling out an implication of their ruling that had been repeatedly raised below. They didn’t invent the connection - they just recognized the need for a fix. (They don’t yet have one.)

Same as with the CR - House leadership acting affirmatively to vest the President with power over tariffs & strip Congress of it. I guess if we get to the point where 77 House Republicans want to strip the President of his tariff authorities, it's going to happen.

This is the bit I was talking about. I’d meld it with a Cortez-Masto question. If the only thing Australia has now is to drop its insistence that US beef be, in fact, US beef? Why even cut that deal? You might get a 0 tariff for a few weeks until POTUS declares a new emergency.

If you read this piece, one wonders if the “open borders” comment by the President today wasn’t him misspeaking (as I assumed) or rather him stating what would be a logical Musk term of his zero tariff EU proposals. Not only zero tariffs but work bilateral work authorization.

The Senate process that has legs is canceling the national emergency, because that's a privileged resolution that has to get a vote in 18 days. Democrats should be introducing a resolution canceling the emergencies every day, setting up daily votes in 2-3 weeks.
