As a European I just can't get my head round this. A family member had a mini health scare a few weeks ago - scans and specialists all arranged in a couple of weeks on the NHS and it cost precisely nothing. They were OK too btw.

It's a problem of seeing everything through the eyes of voters - who don't know/care about institutions or voting systems so it's dismissed as unimportant. But it deeply affects your ability to do the things voters do care about.

It is this, not arguing, but also this Labour party has been strikingly reluctant to occupy the commanding heights of the discourse. The last government made a bunch of attempts to embed right wing bias in institutions and processes; this government is content to leave them all in place.

Again, ask yourself, would any of this be happening if the Supreme Court ruling went the other way? Would the Government be rushing to enshrine trans protections? Would there be calls to assess the damage of GC hate that “captured” the media? Would MPs be lining up to declare trans women are women?

The Supreme Court case arose because the Scottish Government issued guidance that went well beyond what the law actually says. It feels like there’s every chance the EHRC has just made exactly the same error in the opposite direction. And it could just as easily end up back in court as a result.

As many of us have pointed out, the judgement gave no kind of clarity. This new EHRC guidance is horrible to read, with numerous practical inconsistencies and injustices for all our daily lives not just trans people. It’s the rights equivalent of an Escher drawing that should be immediately removed.
