Because immigration detention is not "punishment" it is both 1) interminable (eg not entitled to bail) and 2) does not require a criminal charge. You can be stopped, detained, and jailed without an opportunity to challenge your detention without a "crime."

Hilariously craven. Democrats invoked a law allowing Congress to override Trump’s “national emergency” declaration, which allows him to impose unilateral tariffs. Requires a vote within 15 days. To avoid a vote, the GOP declared that the entire rest of this year will just be one very long day.
