In particular, the Court had enormous discretion over what vehicle to use to announce its new rule sharply limiting nationwide injunctions. Why choose a case involving what is probably the most egregiously anti-constitutional action an Executive Branch could take?

First, the Court had lots of opportunities during the Biden Administration to tell lower courts they couldn't issue nationwide injunctions. (I know, the cool kids call them "universal injunctions." I'll use the equally imprecise but more familiar term.) So why wait until now?

i expect the problems arrived somewhere between thom tillis going “mask off,” murkowski’s alaska package being ruled out of order, and elon musk going guns blazing against the entire bill.
