The TN is only for certain enumerated professional occupations. H-2A is the seasonal visa for farm workers.

We certainly don't expect it to get any easier for H-2 visas. I have clients that suffer every year if they miss the cap and don't get workers. It is economically devastating to their businesses and as a result the local economies and communities. I practice heavily in the H-2 space at my firm.

There is no annual cap for H-2A but the process is still quite arduous and expensive for farmers. The H-2B program demand has outpaced supply for a decade at least. I practice directly in this space and see the struggles of small businesses that rely on H-2B and miss the cap.

Such a sad, but common, story. There is very little transparency at the consular level and officers have a great deal of discretion to make determinations such as ties to home country. I routinely practice in the H-2B space and have seen this for a few consulates recently. Sorry for your experience
