So I think it's crazy to use a skeleton and what it is buried with to assume the gender roles of a society that we have no other means of investigating, especially when the underlying assumption is that they had a two genders model when we know not all societies have that model.

I disagree that it is measurable. The reclassification of the sex of so many skeletons when they were DNA tested shows that the physical signs used to sex them at first clearly are not dependable, but as we know some women have XY chromosomes and some men XX, DNA testing isn't definitive.

I dont believe that DNA defines gender, so I don't believe it is possible to identify the sex of a skeleton.

In the 88 page judgement it says current law stands that you can sue based on a protected characteristic even if you don't have it, if you are perceived as having it. I.e. if you are beaten up for being gay it doesn't actually matter if you are gay.
