That's not what the article we're discussing says. Judges are being asked. The judges can review the details and say yes or no. In some cases, they do say yes.

In immigration cases, if you lose a case, you can be sent home. Not fun for the person involved, but legal. The person isn't being executed by the US government or anything like that.
These cases are being reviewed by a judge. Foreigners don't have a right to enter the United States.
