It's especially galling that Trump administration stops construction of an offshore wind farm, purportedly because it would hurt whales (no evidence that it would), on the same day it announces plans to gut the Endangered Species Act. And this runs directly counter to two big Trump goals: 🧵

I don't think this order does anything. Sec. 5(c) says, "This order shall not apply to regulatory permitting regimes authorized by statute." Every one of the items listed is a regulatory permitting regime authorized by statute. The order itself lists the statutes. And if any regulation was 🧵

The President has no authority on his own to nullify state laws. This Executive Order is toothless. Trump is directing the Department of Justice to attempt to intervene in the numerous lawsuits that are challenging the state efforts he doesn't like. It will be up to the state court judges who 🧵

As of Friday, there have been 46 cases in which federal judges have blocked Trump policies. The rulings in those cases have come from 39 different judges appointed by 5 different presidents (of both parties) to 11 different district courts across 7 different circuits. Maybe it's not the judges?
