The article frames Skrmetti as a poor strategic gamble by activists. In reality, Tennessee passed a categorical ban applicable solely to transgender adolescents which was framed in sex-based terms. The choices were (a) challenge it or (b) concede defeat in advance and abandon trans teens nationwide.

Seemingly lost in all of the NYT coverage is that what the Supreme Court did was effectively lower the evidentiary bar that state's have to meet to justify their bans. The lower courts that applied heightened scrutiny universally blocked the bans.

One thing I am seeing misreported in the media today about the Skrmetti ruling is a claim that the supreme court ruled this is "about age, not transgender status." SCOTUS also ruled this is about "diagnosis, not transgender status" Bans targeting adults are likely legal under this ruling.

The 'revelation' here is a bizarre NYT hit piece on a researcher who said she wanted to make sure her findings were accurate before publishing them.
