@reuters.com should sue Musk now. @pastpunditry.bsky.social and others have neatly documented the right’s history of attacks on the mainstream press. One reason the attacks work is that the press’s standard response is to do nothing about them. Defamation law exists for these occasions. Use it.

Highly necessary. That a concept - even a foundational one - had broad appeal in the past doesn't guarantee it'll retain that appeal. Proponents need to keep reminding the general public why the concept is good, or else it gets stale.

I would guess that most (not all!) 1A academics become 1A academics because they reflexively prioritize speech above competing interests. Cases like this suggest why that might be a problem for academia and 1A scholarship.

Gabe is absolutely right about this. Unfortunately, this place is loaded with very loud, very self-certain speech fundamentalists, so I expect he’ll be a lonely voice of reason in whatever discussion this precipitates here.

Pretending that ABC just settled an easily winnable case is ridiculous. First, as a factual matter Stephanopoulos did make false statements ten times about what the jury did. There are lots of good reasons not to file a defamation lawsuit over a deepfake video. Most of them are glaringly absent here. For all its limitations, the law can be a valuable tool for vindicating truthfulness, but it only works if people actually use it when the right circumstances arise.

I see that being able to credibly sell a piledriver is no longer a condition for leading DOE. We used to have standards in this country.

The trouble with making “heterodox” part of your identity is that it very easily slides into a kind of adolescent rejection of whatever the mainstream view is, even when the view is mainstream because, boringly, it’s so clearly correct.
