On 11/12/24 DC Circuit Court of Appeals held that CEQ does not have authority to issue regulations regarding NEPA, essentially nullifying 45 years of agency procedures and many judicial opinions. NEPA chaos. Congressional response may eviscerate NEPA and public involvement in agency env decisions.

On 11/12/24 DC Circuit Court of Appeals in Marin Audubon Soc’y v. FAA nullified CEQ’s NEPA regulations - throwing NEPA implementation into extraordinary chaos. SCOTUS may address this issue during their consideration of the Seven Counties case. As a result,Congress may effectively repeal NEPA.

On 11/12/24 the DC Court of Appeals nullified the CEQ’s NEPA regulations in a case titled Marin Audubon Soc’y v. FAA.
Given incoming Administration Senate and House, this judicial opinion might be the beginning of the end of NEPA.
