and of course there's nuance to this all. if a big artist is "heavily inspired" by a much smaller artist, that sucks and is pretty scummy. and same goes for straight rip and resell strategies, etc etc

it is inherently transformative, as it is filtered through the painter's mind and hand (or any variation thereof), so the idea that "1-1 referencing for profit is inherently unethical" seems very strict to me

as i said, while its unfortunate that AI is a step in his process and i wouldn't buy a painting from him due to it, the fact that he used source material that wasn't his for financial gain seems like an odd point to have

and used it as a 1-1 reference for their own painting to sell, without asking for permission, i think that would be within their right. along with say, collage artists or samplers who rip directly from source material.

i won't disagree that midjourney is a plagiarism machine, though i feel like it is unfair to say him selling his work is unethical. for example, if an artist looked up "roaring lion" on google images and found a photo of a non-CC image of a lion from a professional photographer >

is it taboo to paint something using someone else's non-AI photos as reference? kinda sucks that ai is used in their process instead of using real photos but i don't necessarily think using it as reference is the problem here
