The Adjutant General still commands the CA Guard under orders of the Governor - not directly from POTUS - unless the Insurrection Act is invoked right? So is the Adjutant General defying his chain of command?

Steve is way smarter than me and may be supported by case law but to me this does read as a substantive veto, albeit one that would potentially entail consequences for a Governor using discretion where they legally have none.
Perhaps a procedural move by the administration to justify 10 USC 332-4.

That still doesn’t speak to the final paragraph of 10 USC 12406:
“Orders for these purposes shall be issued through the governors of the States […]”
To me that reads as giving no discretion to the governors, but certainly Newsom could refuse and face the consequences.

The Adjutant General is under the command of the Governor unless and until 10 USC 332-4 is invoked.

Perhaps that is what they’re setting up to invoke 10 USC 332-4, but either Newsom complies or they invoke the Insurrection Act. This isn’t title 32 so there is no third option.

The WH claims it’s using 10 USC 12406 which would mean orders flow through Newsom on the authority of POTUS.
Strictly speaking I don’t think he has discretion whether to actually issue the orders, but he certainly could refuse to do so. And should.

I thought that if the National Guard were under ongoing orders from the Governor of the state then they couldn’t be federalized under 10 or 32…I swear I remember reading that somewhere.
