The Greens proposed massice arms support during a time of elections. It could have passed the parliament. But the conservatives refused. Now the conservative want to do the same but with the little difference to spend more on social injustice and some of their buddies.

There is something like "Richtlinienkompetenz". He still needs his coalition partner and the parliament. Actually he lacks the numbers once the new parliament is formed. I wouldn't be that optimistic about your "German" section.

It protects them according to their rules. Read those. Understand them. Make your decision. If it doesn’t suits you: apply somewhere else.
And … it isn’t a franchise. Think of it as the German equivalent of a formal, legally recognized nonprofit organization.

The court ruled that the association was right in doing HR according to their self-imposed rules. They judged about a formal process which has nothing to do about freedom of research. That person can go and teach/research at a state university. But no more at MPG

In my opinion, you are making the mistake of comparing a private association (mpg) with the state. The private association can regulate itself and set framework conditions (within the legal system) ... this has nothing to do with the generally protected freedom of science

I see the point of having different values as a society and building a legal and social system on it. But what is your point about US research vs German then? Articles 5 of German constitution explicitly grants freedom of research.
