They get the basic facts wrong, unsurprisingly. Troops are absolutely going on patrol with ICE. This was discussed at oral argument, and there were even photos in the parties' exhibits.

I'm disappointed that all three judges failed to connect the predicates for invoking the statute to the requirement that the orders have to be issued through the governor. Deference to the President on the former makes a lot more sense if the President and Governor coordinate on deploying the Guard.
