Ruling is a victory - the law is upheld and the AG has authority to enforce it. The Executive Office of Housing and Livable Communities will have to re-promulgate the guidelines as regulations...but that will not result in any substantive change to the law or its implementation.

🚨The MA Supreme Judicial Court has upheld the Attorney General's ability to enforce MBTA Communities. The AG "has the power to bring suit for declaratory and injunctive relief to enforce § 3A and its corresponding guidelines." Guidelines will need to be reissued clearing up a clerical error.
