If only we had a body, one with democratic legitimacy and powers conferred by a Constitution, that had the authority to overrule a president who seeks to impose arbitrary tariffs and deport people who fled here to escape oppression. It could be called the Congress of the United States.

Smith is not making the claim a jury would have convicted. He is restating the standard prosecutors must meet before they can indict, that he believed there was sufficient evidence to obtain & sustain a conviction. The decision is left up to the jury. Justice is done when they have that opportunity.
