There's a really strong argument that reassignment of sex in the Equality Act is not dependent on GRC, and acknowledging that would not be inconsistent with the SC ruling.
Sex is reassigned, not by GRC, but by completing all or part of a process to change physiological or other attributes of sex.

They ruled that "sex" in the Equality Act isn't changed by Gender Recognition Act.
GRA exists because UK was found in breach of Article 8 for not recognising a trans person's sex consistently across the statue books.
SC has put UK back in breach because EA and GRA are now inconsistent.

It's not designated a naturist beach but the council removed the by-law that said nudism wasn't allowed on beaches. So, nudity is not illegal.

The thing to realise about segregation here is that it's NOT trans people who are being segregated...

Yeah, GRC should not be the determinant, but the EA should recognise *something* that means a person's sex has been reassigned for the purposes of the Act. Like, maybe there's a clause in the Act somewhere that describes a process that would reassign sex...

The definition of Gender Reassignment in the Equality Act describes how sex is reassigned (i.e. changed) that doesn't rely on the Gender Recognition Act. It says sex is reassigned through a process of changing physiological or other attributes of sex. No GRC required.

Likewise, they used the term "biological sex" to mean "sex assigned at birth", which completely ignores the biological realities of that person's adult sex characteristics which may develop differently or may have changed through a process of changing the physiological or other attributes of sex.

In their response, they didn't even attempt to refute that they had intended "biological sex" to be used to mean "women who aren't trans". They say it's a matter for parliament... yet as soon as the SC (not govt/parliament) defines it as "women who aren't trans" they rush out exclusionary guidance.

EHRC exists to give the government plausible deniability for human rights abuses.
EHRC can provide guidance and the government can act under that guidance. When those actions are in breach of human rights the government is protected because they can assert it was acting under advisement from EHRC.

I think it's actually worse than that.
They don't even add the "because I thought I wanted to be a boy" clause.
They literally think enjoying hobbies that are typically "masculine", having short hair, or wearing boys clothes means you're infected with the trans.
