You are correct he could declare martial law without an event...however that won't give him the cover he wants to make it "seem legitimate" and be able to go on national TV and have someone to blame and the nation is the victim of "these people". It is how propaganda works.

Well Trump is searching for his Reichstag moment to turn the Armed forces on the citizens and declare martial law. It could be MAGAs that protest. It would not matter. He just needs the opening to do it. Then it will be up to the citizens as to what they do. We will see what happens.
