Holy shit I fucking got it. I've been awake since 4:03am, I drove 95 miles, got here at 7:10am, and at 4:29pm one of the peregrine falcons attacked TWO pelicans and made contact on THREE attempts. 17 useful frames.

The idea that DOGE merely advises rather than directs agency decisions is a key part of the government’s defense in suits alleging Appointments Clause violations.
Elsewhere, DOJ has argued that DOGE is not an “agency” subject to FOIA bc its role is limited to advising and assisting the president.
