It's an interesting development because part of the quiet labor int'l students perform for places like Harvard is to legitimize the academic profile of the institution. Eliminating their ability to enroll foreign students hurts their global brand.
There'll be plenty of people ready to argue this is great ("all those spots should be going to American kids") - which is nonsense - but between this and eliminating OPT, the current administration is doing incredible harm to, arguably, the country's greatest industry.
It depends on where things go from here and how long this lasts. Part of Harvard's draw is that it educates the best and brightest from across the globe, ala Oxford, Cambridge, Yale, Stanford, etc. This is a big loss for them, even if it's just symbolic.
I mean this earnestly: it seems like a lot of international students will simply make the decision to not go to school in America now due to fear of this administration.
I would assume so yeah, I would bet a federal judge would be very friendly to a TRO letting any students currently in-country remain in place tho. It's kinda the exact definition of what that's for.
I keep thinking back to this and how Tarman emphasized the Harvard situation as a key driver of global attitudes towards the US as a destination for capital. It's just one guy from one social context, but it's still fascinating.
To get a student visa, and to maintain nonimmigrant status, a student has to be enrolled in a school that is approved as part of the student visa program. The program (SEVP) is administered by DHS.
And they say applies to existing foreign students!

Yeah, administratively it’s the same situation as if, for example, DHS determined that a school is fake and doesn’t teach classes. Those students would also have to transfer in order to stay in the country.
The “visa” part not crucial. The same certification is required if, for example, you entered on a tourist visa, and are seeking to change status to enroll in school—the State Dept would not be involved in that scenario. Or if you’re transferring from one school to another.

I don’t think every one will stay away. I do think that very talented international students are going to assess that the US is not worth the risk when they have other good options (even if somewhat worse, for now).
