Textbook authoritarianism. Wildly illegal. Presidentialism run amok & captured by fascists. Fixing this is not a job for the courts. It's a job for Congress. And we are experiencing the total failure of Article I of the Constitution.

The institutions of government are failing, it is up to the American people to defend their democracy and constitution. People in the streets stopping business as usual can fix this.
The courts can & should keep ruling against this wildly illegal authoritarianism. But we're already seeing that Trump is not complying with the courts. The only actual fix for this is impeachment & removal. And there is ~no chance of that happening. It is a total failure of the constitutional order.
100% agree with this. But again, this is ultimately not a problem. It is a problem. There is no legal solution for dealing with a runaway authoritarian executive that is openly defying all of the courts, including SCOTUS. Article III cannot substitute for Article I.
Congress has extra shameful abdicated their substantial power. And for what? Some asshole that’s screwing over their constituents? Why do I care more about their constituents than they do?
Congress has failed as coequal branch. A governing majority of both chambers feels it is their obligation to help Trump destroy the Republic, not save it from him.
It's failed because 80 million americans want this, voted for this, supported this monster TWICE. Racism and hate rule murica. It's a systemic problem, it's not one man. America is in decline and falling into massive corruption. It didn't happen in a vaccuum, now you are importing racists from SA.
It is past time to think through possibilities for a peaceful breakup of the country. Civilized Blue Americans deserve better than to be locked in the same polity with our inferiors who voted in this Nazi sycophant legislature.
And not everyone has the lawyers/resources that Harvard does. This will likely be overturned but will still have a chilling effect on other institutions.
More than we ever understood, our “constitutional order” was just a manifestation of our culture’s ability to recognize decency and promote it to positions of power.
Our culture is now terrifying indecent, and power is held by profoundly corrupt, indecent people. That’s where the breakdown lies.
There are, I've been told, many, many authoritarian countries with beautifully crafted democratic constitutions. A constitution means nothing in a nation that rewards corruption and the abuse of power.
If there is "~no" chance of it happening as you say, then we should at least make them vote no.
As of now, the only thing stopping attempts is Democratic leadership opposition. Reminiscent of Tip O'Neil's position on Richard Drinan's impeachment res. against Nixon. And we know how that turned out.
Your remark about this being a failure of the constitutional order makes me worry about whether the US Constitution can survive under Trump. He's already revising and deleting our history.
The Constitution is failing us now. We may never have another national/COngressional "free and fair" election from this point on. The digital Coup d'état in 2024 should have been contested by the DEMS. Pride, ego, & fear of a blowback made the DEMS leaders not demand a recount in Swing States.
And behind the failure of Congress, I have to say, is the failure of a solid plurality of this country. A GOP-majority Congress won’t hold the regime accountable because they believe they’ll face electoral defeat for doing so. That’s both political cowardice and a damning indictment of GOP voters.
Another day, another court case about Republican disregard for the rule of law and the traditions of a great nation - built on the work of generations of immigrants.
We are living in a fascist state. It’s not the courts’ or legislators’ fault; they’re part of the state. It’s the voters. And I’m afraid the majority are willing to accept it, either ignorantly or apathetically.
