I got this one wrong, too. There is in fact language in the bill that allows for tips to be an above the line deduction. Similar to HSA, it can be taken by non itemizers. See page 753 of the bill.

Most people in the lower tax brackets (hourly overtime workers and tip employees) don't or can't itemize. Just taking the standard deduction saves them nothing.

They can remain part of income but should come off the top line income before the standard deduction is applied when filing. One would need to file to get the refund, but the tips would count toward SSA income and not be taxed.

Not sure if it is still this way but when I was in food service servers were required to pay out a percentage of their sales, reflecting the tips they are “suppose” to make. Even if they don’t they still have to pay that percentage. And that doesn’t even include the support staff who get a cut too.

I recall hearing that anything that wasn't your salary/hourly wage (e.g. a yearly bonus) was a "tip" and so Wall Street trader million dollar bonuses wouldn't be taxed.
The SCOTUS ruled in Snyder v. United States that a bribe is not a "bribe" if the prize you get for doing the thing comes after you do it, not before. So all those bribes that SCOTUS justices and politicians get are now "tips" and thus tax-free. It wasn't about regular people with jobs that get tips.
That is why they are holding this Republican session at 1 am. They cannot escape the truth that raising the debt ceiling by 5 trillion dollars while overtly harming the poor and working AND middle classes to allegedly save money from fraud and abuse is nakedly dishonest and evil.
Most people don't make enough to itemize their tax returns. That's why it pisses me off that people say it's saving you money you can take a tax deduction. Not when you are poor, those deductions can only be taken by the well off.
