If a design mark embodies enough creative expression to constitute a work of authorship, then theoretically it could be protected under both regimes. I wonder if there’s ever been a case finding a particular mark is double protected.

In the federal appeals court where I did most of my work, argument was typically 4-6 months after the final brief was submitted. So the judges and their clerks had quite a bit of time to prepare to grill the advocates!
