Since everything was a 0day at some point then it’s redundant to mention it after it’s a cve so you just list the cve and if it was exploited as an 0day prior then you can just say that

People sold prior they were down about 10% going into this morning

For them to be enforceable you have to be paid something so in each of these cases the victim is taking their payout directly rather than going to court and they should be fine with that before signing the agreement to sell it. Else they shouldn’t take the money so they can do what they want
