1) Unfortunately someone saying you're a "gangbanger" is not a crime. His only crime was coming into the United States illegally. 2) He was granted a "withholding of removal" status. So he was here legally after that point. 3) I don't care about him. Just the constitution.

Whether he was here illegally isn't of any consequence whatsoever. He gets due process under the constitution. That's how it works. You have to actually prove in a court of law that he's here illegally. Otherwise I could pick you up off the streets, call you illegal and carry you off to El Salvador.
