We won! The Supreme Court reversed the Eleventh Circuit's decision that the Supremacy Clause bars claims brought under the FEDERAL Tort Claims Act today. There's more work to do now. But the unanimous court just told CA11 it needs wade into the circuit splits and "carefully reexamine" our case.

Good news feels rare these days. The Supreme Court unanimously agreeing this family’s lawsuit should be able to proceed—after the FBI blew up their house because they didn’t check the address—is a refreshing exception. The govt shouldn’t be held to this rock bottom standard.

i know some of my courts friends may not like this, but it’s not okay that judges are letting these people rot in a deadly foreign gulag while they take months to debate whether the government is disobeying their orders intentionally. it directly devalues their lives.

People are being disappeared regularly now and the likely truth is that far more people are being disappeared than we realize, with only a few cases being "lucky" enough to get any attention or noticed.

@ij.org has a Fourth Amendment case against Norfolk, VA’s Flock cameras. The interconnectivity of the tech makes these cameras a national issue. It’s unsurprising that the feds are now tapping into the massive surveillance network that Flock’s building. bit.ly/45suJhv

The real problem with the Supreme Court’s expected Fed carve out is not that it lacks a principle but that the real principle isn’t articulated. The reason it will carve out the Fed is functional but it won’t say that. And its jurisprudence doesn’t leave room to ventilate the functional arg.(1/8)

Reminder that Khalil hasn’t even been charged with a crime—he was arrested without a warrant TWO MONTHS AGO for exercising his 1st amendment rights as a lawful permanent resident. And DOJ is saying that he can’t even be allowed to hold his newborn child. Just despicable levels of inhumane treatment.

Courts really need to stop treating these people like good-faith actors and start filling their jails with DOJ attorneys.

It needs to be a lot easier to sue for malicious prosecution.

This is a big reason why the Supreme Court is fine nullifying rights it doesn’t like, as it has with the 4A during traffic stops. People like the justices rarely have to worry about how cops will abuse their power.

It was easy, even fun for me to sue some federal judges in a court where I’ve never practice. Daniel, on the other hand, had to put his livelihood on the line to stand up against judges who were violating his First Amendment rights. That takes guts. We need more people like Daniel these days.

CoreCivic’s Tennessee prisons are chronically understaffed death factories, and it is outrageous that the TDOC not only has done nothing meaningful to ensure CoreCivic’s compliance with minimum contract requirements, but has lobbied to ensure that CoreCivic does not incur meaningful consequences.
