So I’m thinking that the DOJ, in moving to dismiss without prejudice, may seek to revive this prosecution after Trump leaves office, by arguing that the statute of limitations was tolled while he was president.

JUST HITTING THE DOCKET:
Special Counsel, Jack Smith, has now filed his Unopposed Motion to Dismiss (without prejudice) the superseding indictment in Trump’s DC federal election interference case.

again “once his term is over or he is otherwise removed from office by resignation or impeachment.”
"Dismissal without prejudice is a legal term indicating that charges have been dismissed but can be refiled at some point."
Oh, and DON'T obey in advance by telling he'll never leave. Rolling over without a fight is very Un-American and paves his path needlessly.
He'll leave feet first. That's it.
For what? He's not charged with anything.

He will never face consequences. Ever.
It would be better to release it all instead and let us know every dirty detail before Bondi buries it for eternity.
The thing to hope for is that Garland releases Smith's report to the public before inauguration day.
There is absolutely no reason to let up on them.
He'll get his pardons, end of story.
Otherwise, what are we even doing.
And why are y'all asking people who hemmed & hawwed for 10yrs about what the courts would do.
There are BP in jail for crimes they didn't commit/less heinous crimes
I can no longer ever listen to anyone in the criminal just field bc it's clearly for BIPOC & the poor.

If DOJ re-prosecutes, and if the case is not resolved on other grounds (dismissed due to immunity for example), then the SOL question is fair game

Typically what the DOJ wants, the DOJ gets outside of rare circumstances

why are we still so deluded that we think constitutional norms still apply?
And getting popular ratification?
Um... I don't know if technicalities are at issue here.
The case against DT is over.
Even if his lawyers don’t get it changed to ‘with prejudice’ he’ll be 83 years old when his term ends. I don’t think any prosecutor will pick up the case.
He could also step down 6 months before his term ends so JD can pardon him.
Rich white dudes are above the law. He won't be held accountable for a damn thing. Not a single damn thing - hell, he was rewarded with the highest office in our nation.
I give up at this point
This was over on Nov 5th.
Of course, with our luck is that he will escape justice by croaking!!😉
I'm thinking about this happening the same day Biden is pardoning a turkey
We've become a clown show
And, well, win.
They won't do a damn thing.
(Insert actual WORKING AG.)
Don’t even pretend.
He will either be dead by then or find another way to evade accountability like stocking DOJ with his cronies.
Imo that was the one chance.

They’ve had 4 years to do something and they’ve done nothing to any of the leaders of J6 😑
Thanks Garland and Jamie Gorelick
