While awaiting Chutkan’s ruling her questioning made me think of those people who seek TROs against an ex but the police say “until they do actual harm” we can’t do anything. The law requires solid proof of harm but DOGE can end jobs and funding based on nothing more than a word search. Scary times.

I know you mostly cover federal issues, but at the state trial level it’s also sometimes a matter of caseload. Those judges often don’t have time to do a deep dive. They check the citations, rule, and go to the next case.

In my years of practice, I tell my clients one maxim to remember regarding court decisions is that when a judge says "not yet"- it is not a loss on the merits it just means the judge is saying ... "I need more" ... and you keep collecting facts to bolster your case and try to make better arguments..

I've been doing this for a long time. I covered the first Trump administration, and I've been writing about the courts for more then 20 years.
