2001 AUMF is still in effect. Technically, the President can say we're "at war" whenever he wants. Yet another power Congress unconstitutionality gave up.

During the Muslim ban arguments, Roberts had to be shamed to write that the Japanese Internmen had "no place in law under the Constitution".
Ought to be interesting how to see how Roberts would rule if pushed.
