And to make it clear that enslaved Black people could have no rights, instead of looking at whether Dred Scott was the citizen of *a state* (the relevant question for diversity jx), Racist Taney chose to rule Scott could not be a citizen of the United States (not the relevant inquiry)

there is a famous decision (sorry...name of it escapes me), written by Sandra Day O'Connor--about whether to execute a guy..her first line was.."this is a case about federalism..."
the guy was executed, but at least he died for state rights and procedural certainty.

This 10 year old article descibes well Robert's method of dismantling the rule of law: pretend the law still exists but make it impossible for people whose rights have been violated to seek redress from the courts.
