oh, those are good ones. legally, the court says the clause applies to individuals who hold continuing positions and exercise "significant authority" on behalf of the united states. there's not a crisp test for what significant authority consists of, but administrative judges are thought to have it.

The Bureau of Investigations was created as a task force under the US Attorney General with a "chief" appointed by the President at the AG's recommendation. When Hoover was appointed chief by President Coolidge it was still an inferior office until Hoover decided to... not be that.
